I discussed this question at the

Foreign Office today. I made it clear that we

could in no circumstances proceed with the order

of deportation to Saigon under Section 6 of the

Ordinance pending the result of the appeal to the

Privy Council, and this was generally agreed.

On the other hand, the Foreign Office are very

anxious to meet the wishes of the French Govern-

ment as far as possible and, pending discussion

with the French Government, they are not satisfied

that a mere order to Nguyen ai Quoc to leave the

Colony within a specified period would meet the

case. It is possible that if the French

Government were presented with the two alternatives

they would prefer that he should be detained in

Hong Kong pending the result of the appeal to the

Privy Council. I am not clear that we have

legal power to detain him in actual custody

indefinitely pending the appeal, but presumably
